Do I have a valid claim?

The duty arises when the law sees a relationship between two individuals that requires them to act in a specific manner. A Breach occurs when one party disobeys that Duty they owe to an individual. Cause, in fact, occurs if “but for” the actions of the individual the accident would not have occurred. Proximate cause relates to the individual’s actions to the results of the accident. The “at fault” party may only be liable for consequences which are reasonably foreseeable. Lastly, there must be actual damage to the individual who is the victim of the breach.
