Ohio Personal Injury Attorney | West Chester Family Awarded $1.63 Million in Medical Negligence Case


A Hamilton County jury has awarded a Westchester, Ohio family $1.63 million in a lawsuit that found two doctors negligent for a birth injury that left the infant with a seriously injured right arm.
 
Dylan Nitzsche, who is now a four-year-old, is not able to use his right arm. He was injured at birth. Dylan who weighed 10 pounds and 13 ounces was delivered vaginally despite his mother’s request for a Caesarian section. During the birth, his shoulder got stuck in the birth canal. He was injured when doctors tried to free him.
 
The medical negligence negligence case also alleged that the mother was not properly monitored during the pregnancy. Amy Nitzsche had been diagnosed with gestational diabetes during a previous pregnancy, but was not monitored for gestational diabetes in this birth. Gestational diabetes can lead to unusually large babies and difficult births.
 
The award includes payment for Dylan’s past and future medical expenses, pain and suffering and loss of earnings.
