A 39-year-old Magnolia woman was injured in a one-car crash September 20. According to the Ohio State Patrol, she went left of center while traveling west on Route 183 around 6:30am. She then proceeded off of the road and hit a mailbox and guardrail. The Ford Explorer flew over the guardrail and struck an embankment. The driver was cited for “failure to control” her vehicle. She was taken to Mercy Medical Center, where was treated for her injuries.

Traveling left of center accounts for a significant portion of all accidents on Ohio roads. This can occur because of driver inattention, mechanical failure, as well as other causes.  While we do not know why this particular vehicle went left of center, I have noticed a disturbing trend while I am behind the wheel. More and more people are texting while driving. You can see them looking down at their phones for  a few seconds and then quickly looking up. This usually is accompanied by the car swerving to one side or the other or jerking while braking, etc.  Texting while driving is illegal in at least one Ohio county, and I think this is a good law. There is no reason for anyone to be texting and driving. In my practice, when liability is questioned, we are routinely asking for phone logs of the other party to see if they were texting around the time of the accident. While you cannot see the actual text message sent, you can see when and to whom the text was sent. So don' t think that if you are texting and cause an accident we won't find out about it. A court order for the text messages can be asked for and likely granted. In my experience younger Ohioans seem to be guilty of texting while driving more often than older Ohioans, at least according to what I see in cases that come to my personal injury office.

Stark County, Ohio (population 378,098) had a total of 10,757 reported accidents in 2008. 20 of these were fatal, with 22 fatalities. 2,783 of the total reported accidents were injury crashes (4,028 total injuries). Sandy Township (population 3,679) had a total of 34 accidents reported in 2008.
