WHO CAN FILE A WRONGFUL DEATH LAWSUIT IN OHIO?

An Ohio wrongful death lawsuit may be brought when a person’s death is wrongfully caused by another party. An Ohio wrongful death claim is a civil action and is usually filed by the family members of the victim. The laws that apply to a wrongful death case vary from state to state, this is why it is important to have an Ohio wrongful death lawyer for Ohio wrongful death cases.

An Ohio wrongful death lawsuit is brought on behalf or in the name of the decedent’s estate. Typically, before a lawsuit is brought, a probate court will open an estate for the wrongful death victim naming a close family member, such as the spouse or child, as the administrator of the estate. If there is no spouse or surviving parents, and the children are minors, then the court will appoint a legal guardian. Once an estate has been opened by the probate court, then a wrongful death lawsuit may be brought on behalf of the estate.

Ohio wrongful death lawsuits can be complex, both at the probate level and common pleas level. This is why it is important to consult an Ohio wrongful death attorney who is both knowledgeable in this area of the law and has the family’s best interests in mind.
