A 46-year-old Alvordton woman was killed in a one-car accident October 2. She lost control of her vehicle when crossing railroad tracks at a high speed. The vehicle went airborne, hit a ditch, and rolled onto its top. She was allegedly not wearing her seat belt and was ejected from the vehicle. The woman was airlifted to a Toledo hospital with serious injuries.

In general, failure to wear a seat belt increases the risk of serious injuries in a collision. The seat belt keeps the body from flailing around the passenger compartment, thus reducing impact with the steering wheel, and ejection through the windshield.  In multi-car accidents, defense counsel often tries to argue that the innocent person who was not wearing their seat belt was contributorily negligent in that failure to wear the seat belt contributed to the injury. Plaintiff then has to prove they would have been hurt even if they had a seat belt on.  This usually requires expert testimony.
