Generally, in every personal injury case you cannot be required to disclose your medical history when it is unrelated to the type of injuries suffered in an accident. This information is considered privileged under the physician-patient or doctor-patient privilege. The purpose of this rule is to make patients feel free to tell their doctor the whole truth about what the patient is feeling or experiencing so that the doctor will have all the information to best diagnose and treat a patient.
An Ohio wrongful death claim arises when someone else wrongfully causes the death of the victim, such as from being careless (also known as being negligent). A wrongful death can result from intentional acts or from accidents, such as in a motor vehicle accident, truck accident, medical malpractice, or defective product.
Nothing can ever prepare a family member for the death of a loved one. When the death is caused by someone else’s negligence, it is difficult to understand why it happened. At Chester Law Group, an Ohio wrongful death attorney cannot erase the emotional pain of a wrongful death, but we can help your family obtain the compensation that is deserved.
The loss of a loved one is an emotionally trying time for family members. Unfortunately, we live in a time where insurance companies are not willing to sacrifice profits for even the most severe of injuries sustained due to the negligence of others. Many times, these institutions seek to take advantage of victims in an Ohio wrongful death situation and their families, despite the loss they have suffered. The Ohio wrongful death attorneys at Chester Law Group know that there is no amount of money to truly make the family members of a wrongful death victim whole again. However, we still know that we can fight to keep the victim’s plans for the family alive and seek justice as much as possible by financially taking care of them.
An Ohio wrongful death lawsuit may be brought when a person’s death is wrongfully caused by another party. An Ohio wrongful death claim is a civil action and is usually filed by the family members of the victim. The laws that apply to a wrongful death case vary from state to state, this is why it is important to have an Ohio wrongful death lawyer for Ohio wrongful death cases.
In Ohio, wrongful death laws and claims for wrongful death were nonexistent in the past. A long time ago, there was no legal right or basis to recover damages for a loved one’s death which was caused by the carelessness or negligence of another person or entity, also known as a wrongful death claim. As such, there were no Ohio wrongful death lawyers back then. Once a person died, his or her rights died with him or her. It didn’t matter if a claim or lawsuit was filed prior to the person’s death. If a lawsuit was already filed prior to the person’s death, their case was simply dismissed once they died.
According to the National Highway Traffic Safety Administration (NHTSA), fatalities from collisions involving large trucks have increased from 2010 to 2011. There are a number of factors that may be affecting the increase, i.e. increased traffic on our roadways, truck driver fatigue due to working more hours, increased pressure on companies to make deadlines quicker to stay competitive, poor maintenance to cut costs, etc. Crashes involving large trucks such as semi trucks and 18 wheelers can be especially catastrophic when a smaller vehicle is involved due to the difference in size of vehicles.
Wrongful death claims are brought by a decedent’s surviving relatives, next of kin, or beneficiaries against those claimed to have been negligent and responsible in causing the decedent’s death. In Wrongful death claims, a unique set of laws apply in seeking to recover for the losses sustained by the decedent and his or her survivors and beneficiaries. Every state has its own unique wrongful death statutes, rules, and laws.
One common misunderstanding in all civil cases, including personal injury cases, and Ohio wrongful death cases in particular, is the burden of proof that a Plaintiff must meet to recover. As every experienced Ohio wrongful death lawyer knows. in an Ohio civil case a Plaintiff must prove all the elements of his or her case (that the other party or parties was negligent, that their negligence caused the injuries, and the extent of damages from the injuries) by a more probable than not standard. In other words, the Plaintiff meets his or her burden when the evidence shows that it is more than 50% likely, or at least 50.1% likely, that an element has been met. This burden is far less than in a criminal case where the burden is beyond a reasonable doubt.
