
A: When a loved one is killed due to the negligence or wrongful acts of another, the family has a right to file a wrongful death claim. In Ohio, a state statute governing wrongful death controls who can file wrongful death claims. Although any and all family members may have suffered because of the loss, a wrongful death claim must be brought on behalf of the estate of the deceased family member.
