Who can file an Ohio wrongful death claim?

A: When a loved one is killed due to the negligence or wrongful acts of another, the family has a right to file a wrongful death claim. In Ohio, a state statute governing wrongful death controls who can file wrongful death claims. Although any and all family members may have suffered because of the loss, a wrongful death claim must be brought on behalf of the estate of the deceased family member. This means that the wrongful death claim must be initiated by the executor of the estate named either by the probate court or in the decedent's will. The wrongful death claim is filed on behalf of all the beneficiaries of the estate.
