How Long Does It Take For a Personal Injury Case to Get Resolved in Ohio?

One of the most common questions I get from clients who have been injured in a motorvehicle accident is how long it will take before their claim will be resolved. My response is that it depends on a number of factors. Some of these factors include:

• Liability: how clear is it that the other party is at fault.

• Injuries: the more severe the injuries the more likely that the insurance company will offer a fair settlement quicker.
  

• The insurance company: some insurance companies are more difficult to deal with than others. Some insurance companies make it a practice to not pay for more than 8 weeks of treatment for sore necks, and this means if you need more treatment your case will likely have to be filed in court to get fair compensation.
  

• The adjuster: the individual adjuster assigned to a case can make a difference. For example, a more experienced adjuster who has dealt with us before and knows that we are willing to go to Court will be quicker to offer a fair settlement than a new adjuster who is just trying to make a name for himself within his company by trying to obtain low settlements.
  

• The client: unfortunately, insurance companies will take the individual client into account when making an offer. For example, if the insurance company knows that the person injured is having financial troubles, they know that they will be willing to settle for a lower amount quicker.
  

There are many other factors that can speed up or slow down how long it takes before a fair settlement is offered. Sometimes, if a case is filed into Court, a case can take years before a settlement or judgment is awarded. An experienced attorney can better assess your individual situation to determine around how long you can expect your case to take.
