People injured in a motor vehicle accident due to someone else's negligence are usually on the other end of many tactics utilized by insurance companies to try and get an injured victim to settle quickly and for a low value.
One of the tactics often used by insurance companies to try and minimize the value of a claim is by bringing up the driving history of a claimant. For example, some insurance adjusters will argue to a claimant or his attorney that by having numerous past traffic tickets or DUI's that a jury will not make an award above their offer. An experienced attorney knows however that there are multiple rules of evidence which will not allow the insurance company to make such an argument. This only makes sense. Even if a person has 100 past traffic tickets this does not mean that they were driving the same way on the day of the accident as they were when they received those tickets. This would be like saying that anyone who has a bad driving record is not entitled to recover damages for injuries suffered as a result of someone else's carelessness.
