The Defense Medical Exam in Ohio Personal Injury Cases


In more serious injury cases that have been filed in Court, the Defense may request that you be examined by one of their medical doctors. Most of these doctors are hired on a regular basis by the auto insurance company and are therefore more inclined to give a favorable opinion to the Defendant. However, with the help of a competent personal injury attorney, you may be able to get the Court to order certain restrictions during a defense medical exam (DME). Certain restrictions may include:

1. That a DME be conditioned on the exam being videotaped or done in the presence of a court reporter. This may motivate the examiner to be more honest in his exam findings and conclusions because he knows that his whole exam may be scrutinized by your attorney. It may also prevent the examiner from behaving in a way that would demean you, such as requiring you to do things like undress when unnecessary. This may also deter the examiner from trying to elicit any information from you that may be privileged.
2. Limit the distance required to travel to the DME.
3. Limit the time length of the DME.
4. Limiting the scope of the exam to only relevant parts of the body.
