The Importance of Witnesses in an Ohio Personal Injury Case

Witnesses in an Ohio personal injury lawsuit can be very important to a case and in some instances can be the deciding factor.

Liability witnesses are important when liability is an issue. For example, in a car accident case where the person who hit you claims that they had a green or yellow light, having a witness testify that he was behind the defendant at the time of the accident and that the light was red can solidify the fact that the other party was 100% at fault.

Another type of witness that is many times overlooked and underused is a damages witness. Often times damages for pain and suffering is awarded based on the Plaintiff's testimony and the medical records alone. A plaintiff's testimony is often attacked by the Defense as being exaggerated and medical records almost never paint a complete picture as to how an injury has affected a person's life. This is where a damages lay witness can be effective in helping to illustrate to a jury just how an injury has affected a person's life. The most common damages witness is a family member who was in a position to see just how a person's daily routine was affected. Other, less biased witnesses may also be a good idea who were able to witness on a daily basis how a person was affected by an injury, such as a co-worker or an acquaintance.
